Canada is now offering large investors more certainty to help move major projects forward faster. The CRA has announced it will expedite advance income tax ruling requests related to investments of $1 billion or more in Canada, effective immediately. This news builds on a measure introduced in the 2026 Spring Economic Update to prioritize advance income tax ruling requests for nationally significant projects.
For complex investments, tax uncertainty can affect transaction structuring, financing arrangements, projected returns, and stakeholder approvals. Earlier access to a binding CRA position may help investors identify and address potential tax issues before significant capital is committed.
This new measure aims to provide more clarity upfront so investors can move forward on projects with confidence. Investors considering projects valued at more than $1 billion in Canada will receive priority processing of advance income tax ruling requests, allowing them to obtain certainty on key tax issues earlier in the decision-making process. Currently, the CRA's existing service standard for issuing advance income tax rulings is 90 business days.
An advance income tax ruling provides taxpayers with guidance on how the Income Tax Act would apply to a proposed transaction and is the highest level of tax certainty available from the CRA. Taxpayers may also request a pre-ruling consultation to discuss significant technical issues with the CRA before submitting a formal advance income tax ruling request.
